Yearly Customs Notification

Customs Brokers are licensed by the Treasury Department, and we are required as a Customs Broker to notify you of the following information:

If you are the importer of record, payment to the broker will not relieve you of liability for customs charges (duties, taxes, or other debts owed CBP) in the event the charges are not paid by the broker. Therefore, if you pay by check, customs charges may be paid with a separate check payable to the “U.S. Customs and Border Protection” which will be delivered to CBP by the broker.

If we are currently paying duties on your behalf to Customs and Border Protection, we pay them promptly and have done so for the past 38 years. If you would prefer to pay your duties directly to CBP this can be easily arranged. Our Finance Department can help you set up an ACH account and provide you with the funds due to be debited from your account. Although we do not recommend it, you may also pay by check.

Data Element Requirement for Compliance with Uyghur Forced Labor Prevention Act

Organizations importing have a requirement to maintain a strategy for preventing the importation of goods which are in any way produced using forced labor. While this has always been a requirement, there is a new requirement which CBP has notified us will be put into effect on March 18, 2023 requiring us to transmit MID (Manufacturer Identification Data) including the Chinese Postal Code. The addition of the postal code to the MID is a new requirement.

Reilly International will be updating your Manufacturer ID numbers to comply with the new requirement.

What do you need to do?

If you are importing from China and you have not reviewed your supply chain for potential use of forced labor, do so. If you need assistance, contact us and we will point you to some information which Customs has produced to aid you in exercising reasonable care based on CBP’s informed compliance.

If you are purchasing your goods from an organization in China, but you know they are not the actual manufacturer, instruct them to list the actual manufacturer on your commercial invoice making sure to include the postal code. While we understand that this may be challenging, it is a requirement to access the privileges of importing into the United States.

Postal Codes in China are 6 numerical digits.

If your supplier does not list their postal code (about 20% of our records of Chinese Exporters do not include Postal Codes) on your commercial invoice, we will be contacting you to obtain this. Please aid our team in replying quickly to these requests to keep the supply chain moving.
