Update on Federal Court Ruling Regarding IEPPA Tariffs

As you may have seen in recent news, a federal appeals court has ruled that certain tariffs imposed under the International Emergency Economic Powers Act (IEEPA) were unlawful. However, the court also determined that these tariffs would remain in effect until at least October, as the Trump administration is expected to appeal the ruling to the U.S. Supreme Court. We believe the government will be able to continue collecting these tariffs until the Supreme Court issues their final decision. We hope this decision will be expedited, so that, a degree of certainty will be available to our clients.

What does this mean for you:

All existing tariffs under the IEEPA remain in place until at least October, pending further legal proceedings.

This ruling only affects tariffs under the IEEPA provision.

Section 232 tariffs (national security-based tariffs) are not affected by this ruling and remain fully in effect.
